论货物所有权保留的法律适用 |

| 摘 要： 由于各国有关所有权保留方面的法律规定很不一致,在涉外所有权保留法律关系中,就需要作出法律选择,以确定所应适用的法律。借鉴其他国家有关货物所有权保留的法律适应,中国国际私法对所有权保留的法律适用宜规定为:所有权保留在当事人之间的效力适用买卖合同的准据法,所有权保留对第三人的效力适用第三人购买所有权保留标的物时的物之所在地法。 |

On the applicable law of retention of title |

| Abstract: Because of the differences of retention of title among different countries, we must choose applicable law in dealing with foreign retention of title relationship. On comparing and analyzing applicable law of ,retention of title in many countries, the author suggests that China should provide the applicable law of retention of title as follows: the legal effect of retention of title to the parties of sale contract applies the law of sale contract and that to the third party applies the law of thing located when the third party buys the thing. |
