网络游戏直播监管困境的法律出路 |

| 摘 要： 在互联网技术迭代更新的背景下，网络游戏直播活动面临新的规制难题。被监管主体当中存在网络游戏主播侵犯著作权行为、直播平台著作权侵权行为与不正当竞争行为竞合、直播用户使用行为违法违规等诸多乱象。原因在于网络游戏直播监管主体的监管规范阙漏、监管机构与部门权责不清、监管技术与方式存在缺陷。走出上述困境的法律出路，即从监管主体入手，加强网络游戏直播监管立法体系化建设，理顺监管主体的内部权责分配，革新监管技术和监管方式。 |

The legal outlet for supervision dilemma of online game live broadcasting |

| Abstract: In the context of rapid iteration of Internet technology, online game live events are facing new regulatory challenges. There are many infringements of online game anchors infringing copyrights, online platform copyright infringements, unfair competition behaviors, and live users’ illegal behaviors. The reasons include the supervision of online game broadcast supervisors lacking regulatory norms, unclear powers and responsibilities of regulatory system and departments, and the defects of regulatory technology and methods. The legal way out of the above dilemma is to start from the main body of supervision, strengthen the systematization of online game supervision and regulation, rationalize the internal powers and responsibilities of the regulatory body, and promote the innovation of supervision technology and supervision methods. |
