国际投资争端解决机制改革的多元模式与中国选择 |

| 摘 要： 在传统投资仲裁面临合法性危机的背景下，有关国家、政府间国际组织、专家和学者正在积极推动国际投资争端解决机制改革。目前，国际投资争端解决机制改革实践和建议呈现出多元模式，主要包括投资仲裁完善模式、投资仲裁加上诉机构模式、常设投资法院模式、常设投资法院加上诉机构模式、东道国当地救济加国家间争端解决模式，并辅之以调解、争端预防等灵活方式。以实体维度的独立、问责、公正，程序维度的透明度、一致性以及裁判官的独立性和公正性、效率等各项政策目标组合而形成的分析框架评估，这五种基本模式各有利弊得失。在“一带一路”背景下，立足中国作为资本输入输出双向投资大国的身份和利益，结合国际投资争端解决机制改革的发展趋势，中国应分短期、中期和长期三个步骤，渐进务实地选择投资仲裁完善模式、“一带一路”投资仲裁加上诉机构模式、多边常设投资法院加上诉机构模式。 |

The plural models in international investment dispute settlement reform and China’s options |

| Abstract: Under the background of legitimacy crisis in investment arbitration, many states, international organizations, experts and scholars are actively promoting international investment dispute settlement reforms. At present, the practice and proposals for international investment dispute settlement reforms present plural models, including investment arbitration improvement model, investment arbitration plus appeal body model, permanent investment court model, permanent investment court plus appeal body model and local remedy in host country plus state-state dispute settlement model, supplemented by flexible methods such as mediation and dispute prevention policy. In the context of “One Belt, One Road” Initiative, based on the status and interests of China as both FDI and ODI great power, considering development trends of international investment dispute settlement reforms, China should gradually and pragmatically choose investment arbitration improvement model in short term, investment arbitration plus appeal body model under “One Belt, One Road” Initiative in medium term and multilateral permanent investment court plus appeal body model in long term. |
