能源资源使用权的理论建构 |

| 摘 要： 能源资源使用权制度的构建有助于拓展能源资源的使用价值，筑牢能源资源开发利用的法律根基。不同于用益物权，能源资源使用权属准用益物权，具有明显的公权色彩。能源资源使用权的权源是能源资源所有权。能源资源所有权包括私法上所有权与公法上所有权双层结构。能源资源所有权经由所有权权能分离理论，派生出能源资源使用权。此外，能源资源所有权在权利创设上还须经行政许可。较之于一般财产，能源资源具有较强的公共属性。基于公共利益的考量，公法规范对能源资源使用权的行使与转让等具有较强的限制。但此种限制需要经受比例原则的审查，以保障限制的合理性与妥当性，实现公共利益与个人利益的平衡。 |

Framing of the theory of the utilizing right of energy resources |

| Abstract: The utilizing right of energy resources can promote the use value of energy resources and lay a solid law foundation for their exploration and utilization. Different from usufruct, the utilizing right of energy resources belongs to quasi usufruct, with apparent feature of public power. The right resource of the utilizing right of energy resources is ownership of energy resources. The ownership of energy resources has a dual structure, which includes ownership in private law and ownership in public law. According to the theory of separation of ownership, the utilizing right of energy resources derives from ownership of energy resources. Moreover, on creating ownership of energy resources, administrative license is needed. Contrary to ordinary property, energy resources have obvious public nature. Taking public interests into consideration, regulations of public law enforce a limit on the performance and assignment of utilizing right of energy resources. But this kind of limit should be reviewed by the principle of proportionality to ensure a reasonable and appropriate limit, so as to achieve a balance between public interests and private interests. |
