论地方政府间最低工资标准竞争及其治理 |

摘 要: 我国最低工资标准系行政规制形成的“非市场工资”,长期遁入公共政策空间并成为地方政府间竞争的工具,有违最低工资标准制度的初衷。如何在保留地方政府自由裁量空间的同时,保证地方政府及地方官员行为的合理性成为亟待解决的问题。对最低工资标准及其背后的地方政府间竞争的合理性判断,应当跳出狭义的劳动者保护视角,依据比例原则将审查重点转移至保障经济共同体整体性、流动性和公平性的视角,对劳动者利益进行整体理解,重点在于“协调”而非狭义的“保护”。 |

On the improper competition in the minimum wage among Chinese local governments and its countermeasures |

Abstract: The minimum wage in China is "non-market wage" formed under administrative regulations, which has been in the public policy space for a long time and has become the tool of competition among local governments, violating the rational principle of administration. How to ensure the behavioral rationality of the local government and local officials while keeping the legitimacy of the discretion of the local government at the same time has become an urgent problem to solve. The reasonable judgment of the minimum wage standard and the competition of the local governments behind should jump out of the narrow perspective of laborers' protection. And according to the principle of proportion, the key review should be transferred to guaranteeing the integrity, the liquidity and equity of economic community to understand the whole interests of laborers, with the key lying in "coordination" rather than its narrow sense of "protection." |
