战争与和平主题下的国际法与传统安全 |

| 摘 要： 战争与和平是人类社会和国际法理论中的核心命题，传统安全则是攸关主权国家生存利益的重大关切所在。从纵向历史的发展演进来看，国际法与传统安全两者之间存在密切的联系。就目前而言，国际法在当代的发展具体到战争与和平关系层面，可以从以下两个方面加以展望：第一是和平与战争的语义在一定程度内被重新解读与重塑；第二则是国际法从对和平的“弱法性”理念倡导逐渐过渡到对保障和平机制的强化执行。实现国际法在理论与实践层面上的正确应用，有助于为全球化时代的国家传统安全提供更为完善的制度与价值指南。 |

International law and traditional security under the theme of war and peace |

| Abstract: The theme of war and peace is the core proposition of human society and international law theory, while traditional security is vital for the surviving interests of a sovereign state. There is a close relationship between international law and traditional security under the perspective of historical development and evolvement. Currently speaking, the contemporary development of international law, specifically at the level of relationship between war and peace, can be speculated from the following two aspects. The first is that the semantics of peace and war have been reinterpreted and restored to a certain degree. The second is that international law has been changed gradually from the advocated concept of weak peace into enforcement of safeguarding peace mechanism. To achieve the correct application of international law in theory and practice, it will provide a more perfect system and value guide for the national traditional security in the era of globalization. |
