审判管理中的问题及其解决途径

摘 要: 所谓审判管理,是指运用组织、指导、评价、监督、制约等方法安排审判工作、规范审判过程、考评审判绩效、配置审判资源的过程。从目前的情况看,审判管理工作的改善应着重解决好如下三个问题:第一是审判权与审判管理权之间的冲突问题;第二是审判管理中刚性有余而柔性不足的问题;第三是绩效考核指标设置的科学化问题。目前深化审判管理的基本思路,一是从粗放化管理向精细化管理转变,二是从传统式管理向科学化管理转变,三是从命令式管理向服务型管理转变,四是从刚性化管理向柔性化管理转变。 |

Abstract: The trial management refers to the use of organization, guidance, evaluation, supervision and constraint methods such as the arrangements of trial work, to standardize the trial process, evaluation, and trial performance, configuration, and trial resource. From the current situation, the improvement of judicial administration should focus on dealing with the following three aspects: First, jurisdiction and the conflict between the right to trial management, and the second is to made more than rigid trial management and flexible enough problems, and the third, is to establish the scientific performance evaluation index. Currently we should deepen trial management of the basic ideas, one is to make extensive management to intensive management of change, the second is to change from the traditional-style management to the scientific management, the third is to change from the command-style management to service management, the last is to change from the rigid management the flexible management changes. |
