我国陪审制度的历史及其改革 |

| 摘 要： 我国陪审制度之“陪”，从清朝末年的引进，发展到如今的人民陪审员制度，其中内含了多重的语义和价值吁求。现行立法中的“人民陪审员”，既不是英美法系大众化的“陪审团成员”，也不是大陆法系专家化的“参审员”。人民陪审员制度的改革，应当把握人民陪审之“陪”的语义及其折射的伦理价值需求，在达成共识的基础上，平衡和协调民意监督、政治民主和司法借力这“三重价值期望”，保证人民陪审员的实质性参与，将现行人民陪审员制度“一分为三”：根据不同情况分别实行人民陪审团制度、机册(人民)陪审员制度和专册(人民)陪审员制度，真正实现人民陪审的司法借力和“民主”功能。 |

History and reform in China’s assessors system |

| Abstract: The “accompanying” of our “jury” or “assessor” system remains multiple semantic and value appeals from the end of the Qing Dynasty to now. Our current “people’s assessor” is neither the “member of jury” in the common law, nor the “expert assessor” in the continental law. We should get the ethic value demand in the semantic refraction of the “accompanying” of our “people’s assessor system” in order to dismiss the problems in reform and misunderstanding, and coordinate the “three value expectations” of public opinion supervision, political democracy and justice on a consensus basis to ensure the substantive participation of the people’s assessors in cases. Only dividing the current people’s assessor system into three as follows: the people’s jury system, the machine registering (people’s) assessor system and the special books (people’s) assessor system can we truly enlist the help of the people’s assessor system to the justice and realize its democratic function. |
