卢埃林关于法学研究的思想 |

| 摘 要： 20世纪二三十年代，作为现实主义法学运动的干将，卢埃林积极投身于对法律形式主义的批判中，倡导现实主义的法学研究，且特别推崇运用社会学方法。50年代，现实主义法学逐渐兴盛起来，取得了很多优秀的研究成果，但也存在诸多问题。卢埃林对此进行了冷静的分析，力图引导法学研究向健康的方向发展。关于法学研究的思想是卢埃林思想之重要组成部分，折射出卢埃林的整体法学思想，以及美国现实主义法学运动的部分影像。 |

Llewellyn’s thoughts on legal research |

| Abstract: As one of the leading figures in the Legal Realism Movement, Karl Llewellyn devoted himself to criticizing Legal Formalism and greatly promoted the realists’ approaches in legal research, especially the sociological approach, in 1920s and 1930s. With the flourishing of Legal Realism in 1950s, many outstanding achievements were accomplished and lots of problems arose as well. Llewellyn analyzed the problems rationally and tried to direct the legal research onto a healthy way. We can have a general idea of Llewellyn’s thoughts and a perspective of the Legal Realism Movement through the exploration of his thoughts on legal research. |
