| 摘 要： 金融企业集团属于金融创新的范畴。这一新的经济形式不仅突破了传统的经营理念,而且对既存的法律制度提出了严峻的挑战,如关联交易及与此相联的风险集中问题。因此,如何在集团内部构建一道道的金融防火墙、 解决其与代理法规则之间的冲突性及是否应确立例外性的规定等便成为立法者及监管者所必须深思的问题。 |

Analysis on the Fire Wall of financial conglomerate |

| Abstract: The Financial conglomerates belongs to the concept of financial innovation, which has not only broken through the conventional operation ideas but also challenged the existing laws such as intra-group transaction and risk concentration. Therefore, it is a thought-provoking issue for the supervisors and law makers to construct the Fire Walls inside the conglomerates, to solve the conflicts between Fire Wall and agency rules, and to establish the exceptional rules, etc. |
