| 摘 要： 以“技术标准”为切入点,以美国的反垄断司法判例为素材,对知识产权的保护与反垄断的关系问题展开了讨论,并针对美、日、欧对知识产权滥用引起的垄断问题的法律适用原则进行了评介,以期为我国的反垄断立法及应对实践中出现的知识产权滥用问题提供理论上的参考和借鉴。 |

| Abstract: This article starts with the“technological standards”and further demonstrates the relationship between intellectual property protection and its antimonopoly endeavor based on the pertinent prejudications of the United States. The article also reviews the applicable legal principles on regulation of antimonopoly in the United States, Japan as well as in Europe Union so as to provide the theory, experience and reference for China on legislation and judicial practice of regulating intellectual property right abuse. |
