从纯粹法学到逻辑法学

| 摘 要： 从凯尔森(Kelsen)纯粹法学理论产生的背景出发,通过分析纯粹法学理论的逻辑,探讨了吉野一(HajimeYoshino)逻辑法学产生的过程。借助现代逻辑的工具,分析了从纯粹法学到逻辑法学的逻辑必然以及逻辑法学中的初始元素、法律语句理论、法律推理结构、法律体系理论和法律语句之间的有效性关系。针对逻辑法学的性质争议,通过比较分析后认为:随着心理学、经济学、现代逻辑学等方法的不断引入,法律中的许多未解问题(如主观确信、博弈分析等)必将产生许多新的法律理论。 |

From Pure Theory of Law to logical jurisprudence:

| Abstract: Started from the background of Hans Kelsen′s Pure Theory of Law, this paper discusses the process of Hajime Yoshino’s Logical Jurisprudence by analyzing the logic of Pure Theory of Law. By the use of modern logic method, it analyzes a logic necessity from the Pure Theory of Law to Logical Jurisprudence, and the minimum primitives elements,the theory of legal sentences,the legal reasoning structure,the theory of legal system and the validity relationship between legal sentences in the Logical Jurisprudence. As for the dispute of the nature of Logical Jurisprudence, through comparative analyzing, the author argues that the solutions of many unsolved problems (such as subjective belief, game analysis, etc.) in the law will produce many new legal theories along with the applications of psychology, economics, modern logic method continuously. |
