拉姆佩论刑罚哲学的双重任务 |

| 摘 要： 德国刑法学家拉姆佩的刑罚哲学立场是,刑罚正当化目的指明了刑罚哲学的双重任务,其一,必须在违法性(非法)与刑罚之间,或者说,在有责(过错)与刑罚适用之间的关系上发展出正义的规则;其二,必须学会运用这些正义规则,使人们能够认识到,设立刑罚以针对违反规范的犯罪行为和对此适用刑罚以针对该犯罪人的过错都是正当的。拉姆佩认为,相对主义刑罚理论和绝对主义刑罚理论都不能完整地实现刑罚的双重任务,因而建立抵偿、配置和预防的三元理论对当代刑罚哲学的研究具有新的价值。 |

On dual fulfillments of criminal punishment philosophy stated by Lampe |

Abstract: The viewpoint of criminal punishment philosophy which is stated by Ernst-Joachim Lampe, a German Professor of criminal law, is that the end of punishment justification has showed clearly the dual fulfillments of punishment philosophy. It must, on the one hand, develop legitimate rules according to the relationship between law-breaking (illegality) and criminal punishment, or liability (fault) and application of punishment. It must, on the other hand, learn to use these rules so as to make people understand that establishing of punishments in the light of unlawful actions, together with the application of them in the light of the fault of such criminal, is legitimate. Professor Lampe argues that both relativism and absolutism of punishment theory can not completely carry out so-called dual fulfillments. Therefore, the establishing of a three-dimensional theory, in which includes compensation, disposition and prevention, has shed a
new light on the contemporary criminal law. |
