| 摘 要： 法律是一个历史范畴,总是随着时代的嬗进而嬗进,但不论什么时代,法律都会有基本的伦理价值取向。伦理价值作为一种深层价值理念,虽然反映的是人类的一般共同理性,但因受具体立法状况和需求的影响,必然会随着环境的嬗变而不断异化。当然,由于法律毕竟来源于道德,会受到社会伦理规范的束缚,不可能总是随心所欲,因此伦理价值的最终伦理进路必定是归同。 |

On divergence and return of ethic value in law |

| Abstract: The law is a historial concept, which develops following the times. It has however, basic principle itself in any era. As a deep value , ethic reflects common ideal, but is will diverge with environmental changes because of the influence of legislation circumstance and reqirement. However, arising from ethic, the law is prohibited by ethic and its last ethic tendency returns. |
