| 摘 要： 几乎哈特所有的主要理论都经历了一场场论辩的洗礼。可能由于哈特认为德沃金的批判是众多对其理论的批判中真正具有理论深度与广度的思考,哈特对德沃金的回应也是相当谨慎的,这从1994年版的《法律的概念》的《后记》可见一斑。但是哈特绝未全线退让,而是有所坚持的。从这一来一回的过招中,可以管窥哈特的学术立场以及真理可能的栖身之所。 |

Persistence with Withdrawing
———to observe Hart s academic style from postscript to The Concept of Law(2th edition) |

| Abstract: Most conclusions of H.L.A. Hart have experienced a number of arguments, of which the repudiations from Ronald Dworkin are the most profound and comprehensive. Therefore, Hart s responses to him are abundant in quantity and deliberative in quality, which is obviously shown from Postscript to the Conceptof Law(2th edition). In the bouts of the controversy between Hart and Dworkin, Hart withdrew in some not all standpoints, while persisting in some claims, especially in the fundaments. In this essay, the author tries to analyze Hart s academic style and the position where truth may exist. |
