On the development of loan securitization in China |

| Abstract: This paper articulated the substances and legal features of loan securitization and Asset-Backed Securities (ABS), explored legal issues about the bankrupt-remote mechanism, the legal status of Special Purpose Vehicle, the True Sale of loan assets, and the feature of Creditor s Claim. With an analysis of the legal environment for loan securitization in China, the author put forward some proposals for policy and legislation of loan securitization in China. |
