共同富裕示范区授权立法的方案与路径 |

| 摘 要： 按照党的二十大提出的“全面推进国家各方面工作法治化”要求，共同富裕示范区建设必须由政策引导型向法治保障型转变。中央立法或普通地方立法都不足以解决目前共同富裕示范区法治建设之难题，因此，必须通过授权立法对共同富裕示范区赋能扩权。在《立法法》规定的三类授权立法机制中，地方立法变通授权最符合共同富裕示范区法治建设的要求。可以参考浦东新区法规授权方案，同时借鉴海南自贸港法规授权经验，赋予浙江省共同富裕示范区法规制定权。基于维护法制统一的目的，有必要综合利用各类授权立法的限制性要素，为共同富裕示范区的改革试验提质增效。应当以共同富裕建设为契机，推进地方授权立法的普遍化共享、平等化配置和制度化保障。 |

Options and pathways for authorized legislation in the common prosperity pilot zone |

| Abstract: In accordance with requirement of "comprehensively promoting the rule of law in all aspects of the country's work" proposed at the 20th National Congress of CPC, the construction of the common prosperity pilot zone is bound to change from a policy-led type to a rule of law-guaranteed type. Neither Central legislation nor ordinary local legislation is enough to solve the current problems of legal construction in the common prosperity pilot zone. Therefore, it’s necessary to empower and expand the local legislation of the common prosperity pilot zone through authorized legislation. Among the three types of authorized legislation mechanisms stipulated in The Legislative Law, the local legislative variation authorization is the most suitable for the needs of legal construction in the common prosperity pilot zone. It can refer to the regulation authorization scheme of Pudong New Area, and at the same time learn from the experience of Hainan Free Trade Port regulation authorization, and give Zhejiang Province the right to make regulations for the common prosperity pilot zone. Based on the purpose of maintaining the unity of the legal system, it’s necessary to make comprehensive use of the restrictive elements of various types of authorized legislation to enhance the quality and efficiency of the reform experiment of the common prosperity pilot zone. Taking the construction of common prosperity as an opportunity, it should promote the universal sharing, equal allocation and institutionalized guarantee of local authorized legislation. |
