| 摘 要： “依法判决”和“合理性判决”是内在的统一，是同一个问题的两个方面；而法官只有掌握较高的说理艺术，才能将这二者统一起来。要区别逻辑涵摄与法律涵摄，法律涵摄不是就上下位概念的外延宽窄而言的，而是就上下位概念的构成要件而言的。根据德沃金的“整体性的法律”理论，法律规范包括法律规则和法律原则。不明确的“法律原则”通过理想型法官对判决所作的“建构性解释”，就具有了唯一正确的答案—既是“依法判决”，又是“合理性判决”。 |

| Abstract: “Judging according to law” and “rational judgement” are united in internality, which are the two aspects of the same question, and the judge can unify the two aspects but to grip the higher arguing art. So it is necessary to discriminate between logic subsumtion and legal subsumtion. legal subsumtion is not about the extension width of the hypogyny conception, but about the constitutive importantdocument. According to Dworkin’s “full law theory”, standards of law include both legal regulation and legal principle, the undefined legal principle has the only correct solution by the ideal judge to make the constructive explaining about the judgement, that is to say, it is both “Judging according to law” and “rational judgement”. |
