| 摘 要： 开展诉源治理是我国社会治理现代化背景下提升纠纷化解能力的必然要求。人民法院虽被列为诉源治理工作体系中的参与主体之一，但在体系中的具体定位却不明晰，不仅给法院增添了新的负担，亦阻碍了诉源治理预期效果的实现。借助商谈理论，从社会治理现代化背景、诉讼本质、释放法院功能等三个角度进行考量，人民法院在诉源治理中的应有定位为“提供全面理性规范化沟通平台”的参与者。在实践中，人民法院从诉前、诉中、诉后三个阶段发挥自身在诉源治理过程中的功能，辐射影响各主体进行理性、顺畅的沟通，始终贯彻共建共治共享的社会治理思想及全过程人民民主的理念，从而推动社会治理现代化进程。 |

The positioning of the people's court in the governance of the litigation source |

| Abstract: Carrying out the governance of the litigation source is an inevitable requirement for improving the ability to resolve disputes under the background of the social governance modernization in China. Though the people's court has been listed as one of the participating subjects in the governance of the litigation source work system, its specific positioning is still unclear, which not only adds new burdens to the court but also fails to achieve the expected effect of the governance of litigation source. By employing negotiation theory in business, the article investigates from such three perspectives as the background of social governance modernization, the nature of litigation and the release of court functions, and designates the correct positioning of the people's courts in the governance of the litigation source as participants who "provide a comprehensive, rational and standardized communication platform". In practice, the people's court has played its own functions in the process of the governance of litigation source from the three stages of pre-litigation, in-litigation and post-litigation, radiating and influencing the rational and smooth communication of various subjects, and always implementing social governance thoughts of co-construction, co-governance, co-sharing and the concept of whole-process people’s democracy so as to promote the process of social governance modernization. |
