生态环境损害预防与救济中的行政代履行：功能定位与规范调适 |

| 摘 要： 作为保障性行政行为中的间接强制执行，行政代履行在生态环境损害预防与救济中承担的功能为兜底和应急，并为成本回收提供依据。但在现行法框架下，它在生态环境损害预防中作为成本回收依据的功能遭到限缩，其生态环境损害救济功能也在整体上受到削弱。之所以如此，一方面源于司法权的不当扩张挤压了行政权的运行空间，另一方面则源于环境行政代履行有关条款的内生缺陷。要解决上述问题，应选择环境法典作为规范调适的载体，在其中限制司法手段的适用范围，将应急处置定性为行政代履行，明确行政代履行的内容包含生态环境修复。 |

Prevention of ecological environment damage and administrative substituted fulfillment in relief: Function orientation and norm adaption |

| Abstract: As an indirect compulsory execution, administrative substituted fulfillment serves as a bottom act of remedial and emergent nature in preventing ecological environment damage and in undertaking its function in relief, providing evidence for recovering cost. However, under the current legal framework, its administrative substituted fulfillment function as a basis for cost recovery in preventing ecological environmental damage has been limited, and its relief function in ecological environment damage has also been weakened as a whole. This is because, on the one hand, improper expansion of judicial power has squeezed the operating space of executive power,on the other hand, there exist some inherent defects in the relevant clauses of environmental administrative substituted fulfillment.To solve the above problems, we should choose the environmental code as the carrier of norm adaption, in which the application scope of judicial means should be restricted, emergency response should be defined as substituted fulfillment, and the content of administrative substituted fulfillment should be clarified as including ecological environment restoration. |
