| 摘 要： 随着互联网技术的深入发展，人类社会生活已无法摆脱“电子化”的印记。民事诉讼作为纠纷解决最重要的途径，与信息互联技术的交融不可避免。诉讼电子化已然成为司法改革的重要一环，并备受理论界与实务界的关注。从既有的立法规定和司法实践状况来看，我国诉讼电子化之推进范围过于广泛，且缺乏必要的规制。探究我国民事诉讼电子化之合理边界，应从诉讼电子化的科学含义出发，廓清其与传统诉讼程序间的关系。为因应诉讼电子化的程序推进功能，应综合考虑域外诉讼电子化之发展趋向与我国诉讼电子化的实践困境，确定我国民事诉讼电子化之合理边界。 |

| Abstract: With the in-depth development of Internet technology, human social life has long been unable to get rid of the "electronized" mark. Civil litigation is the most important way to resolve disputes, and its integration with information interconnection technology is inevitable. The electronization of civil litigation has become an important part of judicial reform, and has attracted the attention of both the theoretical and practical circles. Judging from the existing legislative provisions and judicial practice, the scope of the electronic litigation in China is too broad and lacks the necessary regulations. To explore the reasonable boundary of the electronization of civil litigation in China, we should proceed from its scientific meaning and clarify the relationship between electronic litigation and traditional litigation procedures. In order to promote the function of the electronic litigation process, we should comprehensively consider the development trend of the electronic litigation outside China and the practical dilemma of China's electronic litigation, and determine the reasonable boundary of the electronization of civil litigation in China. |
