政治精英与社会冲突治理：机制、实践与模式——以“唐慧劳教案”为例 |

| 摘 要： 政治精英的在场固然是协调利益冲突、维持社会秩序的保证，但也可能因为自身利益而卷入社会冲突，或者诱发乃至升级社会冲突。在信访治理机制下，面对维护社会稳定治理目标的紧约束，政治精英在公共利益与治理绩效之间惨淡经营，形塑出因应个案而形态各异的冲突治理实践。借由“唐慧劳教案”可以发现政治精英与社会冲突治理的关系，并由此洞察当前中国社会冲突的治理模式，进而获得社会冲突治理机制创新与模式优化的视角和路径。政治精英建构“维稳网络”、推动社会冲突升级，并随着社会精英对“维稳网络”的解构而再次介入冲突事件，促成其最终解决。具体社会冲突与抗争是否进入政治精英的“维稳视野”，在很大程度上取决于其规模和影响，而其化解则高度依赖政治精英的临机决断，形成了机会主义的冲突治理模式。通过具体冲突事件的妥善化解与多元化社会安全阀机制的主动构建，推动当前社会冲突治理的模式优化与机制创新。 |

Political elites and social conflict governance: Mechanism, practice and mode with "the case of Tang Hui's re-education through labor " as example |

| Abstract: The presence of social elites can guarantee the coordination of interests conflicts and the maintenance of social stability, but may also involve, invoke or even upgrade social conflicts because of their own interests. Under the petition governance mechanism, facing the tight constraints of the governance goal of maintaining social stability, the political elites take great pains to manage between public interests and governance performances, and finally shape conflict governance practices that differ in different forms depending on individual cases. By way of the case of Tang Hui's reeducation through labor, we can discover the relationship between political elites and social conflict governance, gain insight into the governance mode of social conflicts in current China, and further obtain the perspective and path of mode optimization and mechanism innovation of social conflict governance. Political elites construct a “social-stability-maintenance network,” promote the escalation of social conflicts, and, as the social elites deconstruct “social-stability-maintenance network,” intervene again in conflict events and promote its final resolution. Whether specific social conflicts and struggles enter the political elites’ " horizon of maintaining social stability " depends largely on its size and impact, while its resolution, highly dependent on the political elites’ ad hoc decision-making, has formed an opportunistic conflict governance mode. The study, by properly resolving specific conflicts and by actively constructing a multi social security valve mechanism, promotes the mode optimization and mechanism innovation in governing current social conflicts. |
