不同使用方式下保护作品完整权的侵权判定标准 |

| 摘 要： 我国司法实务对于保护作品完整权的侵权判定标准并不统一。鉴于他人对作品的使用有不同的方式和目的，有必要区分演绎性使用与非演绎性使用来限定对保护作品完整权的保护程度。对于非演绎性使用，应采主观上的思想表达损害标准。对于演绎性使用，应合理地考虑演绎者的创作自由，采用客观上的声誉损害标准。目前，我国正在进行《著作权法》的第三次修改，保护作品完整权极有可能吸收修改权。在立法模式的选择上，建议以一般性规则加特殊性规则的模式，将保护作品完整权明确为保护作品的基本表达不被实质性修改的权利。在侵权判定标准的具体司法适用上，采取区分对待原则是一种较为可行的思路。 |

The standard of infringement judgment for protecting integrity right of works under different circumstances |

| Abstract: In Chinese legal practice, in terms of infringement examination of integrity right, standards are not uniform. In view that others have different methods of and purposes for using works, it is imperative to distinguish usage of derivative works from that of non-derivative woks to determine the level of protection for integrity right of works. For the usage of derivative works, subjective standard should be adopted, which may harm thought expression, while for the usage of non-derivative works, the performer's freedom of creation should be reasonably considered and objective standard should be adopted, which may harm reputation. At the present, Copyright Law is being amended in our country, and integrity right of works may well integrate amendment. In terms of option of legislation mode, a general rule plus special circumstance would be advisable to specify the integrity right of works as the right that can guarantee that basic expressions will not be essentially altered. And in terms of the application of specific legislation in infringement judgment standard, a feasible idea is to adopt distinguishable principles. |
