国家监察体制改革的法哲学思考：立场、观点与方法 |

| 摘 要： 党中央关于深化国家监察体制改革的重大决策，蕴含依规治党和依法治国的内在逻辑，承载着中国特色社会主义法治的立场、观点与方法。其人民立场决定了反腐败必然是“无禁区、零容忍、全覆盖”的鲜明态度,“打铁必须自身硬”的执政品格和“以人民为中心”的价值取向；建立在新时代社会主要矛盾、哲学理念和政治原则基础上的法治观点，是加强党的集中统一领导，人民监督权力，把权力关进制度笼子里；不断认识规律，不断推进理论、实践、制度创新指导下的基本方法，主要表现为政治思维与法治思维、战略思维与辩证思维、问题导向与顶层设计、试点探路与整体推进的思想方法和工作方法。 |

| Abstract: The major decision-making by the Party Central Committee on deepening the reform of the supervision system implies the inherent logic of governing the party and governing the country according to law, and carries the standpoints, viewpoints and methods of socialist rule of law with Chinese characteristics. The position of the people has determined that anti-corruption must be a clear-cut attitude of "no-forbidden zone, zero tolerance, and full coverage", the governing character that "the iron must be hard", and the "people-centered" value orientation; the viewpoint of governing by law established on the basis of the main contradiction, philosophical ideas and political principles in a society of the new era is to strengthen the party's centralized and unified leadership, and the people's supervision of power, to put power into the cage of the system; to constantly understand the law and to constantly promote the basic methods under the guidance of theory, practice, and institutional innovation. All is mainly expressed in the thinking and working methods of political thinking and rule of law thinking, strategic thinking and dialectical thinking, problem orientation and top-level design, pilot exploration and overall advancement. |
