从政策引导到法律主导——我国基本医疗服务政策法律化问题研究 |

| 摘 要： 保障广大人民群众享有基本医疗服务是我国新医改的基本目标，也是党的十八大报告对我国医疗卫生事业发展提出的一项基本要求。我国对广大人民群众的基本医疗服务保障问题高度重视，但在推进和保障方面却还主要依赖政策而非法律。政策与法律的关系决定了法律应当成为我国基本医疗服务供给和保障的主要路径。我国基本医疗服务政策法律化已经起步且具备了一定基础，但与我国基本医疗服务供给和保障的实际需要相比还存在较大差距，需要采取相应的立法对策予以补正。 |

From policy orientation to law leading: On China’s legalization of basic medical service policy |

| Abstract: It’s the fundamental goal of China’s new medicare reform to let most people enjoy the basic medical service, which is also a requirement for the development of China's medical and health services in the Report of the 18th CPC National Congress. The Chinese government has paid close attention to the basic medical services of most people, but the promotion and guarantee of such services depend on policy rather than on law. The relation between policy and law determines that law rather than policy should be the main approach for China to provide and guarantee basic medical services. The legalization of China’s basic medical service policy has been on the way and has laid certain foundation. But in comparison with the practical need in our country, it is still insufficient with a huge gap, with which corresponding countermeasures should be taken to cope. |
