“纪委”与“监察委”合署办公的现实问题与解决路径——以政治系统论为分析视角 |

| 摘 要： 纪委与监察委合署办公是国家监察体制改革的一项关键内容，对党和国家监督体系具有系统性和联动性的影响，涉及纪检监察系统内部不同政治主体之间以及纪检监察机关与其他权力监督机构之间的互动关系。以政治系统论作为分析视角，结合对试点地区留置案件的案例分析可以发现，纪委与监察委合署办公存在如何处理坚持党的领导与保障监察委依法独立行使监察权、如何构建纪法衔接的有效机制、如何用留置取代“两规”和谁来监督纪检监察机关四大问题。鉴于此，进一步完善纪检监察合署办公体制，可以将改善党的领导方式与保障监察委依法独立行使监察权统一起来、优化用留置取代“两规”的法律规范与实践举措、健全纪法衔接的领导体制与工作机制和构建纪检监察机关的全方位监督机制作为四条有效路径。 |

The practical problems and their solution paths of the joint office of the Discipline Inspection Commission and the Supervision Committee: From the perspective of the Political System Theory |

| Abstract: The joint office of the Discipline Inspection Commission and the Supervision Committee is the key content of the state supervision system reform, which exerts systematic and interlocking influences on the Party and state supervisory systems, and involves interaction between different political subjects within the discipline inspection and supervision system as well as the other supvervisory agencies in the Party and state supervisory systems. Taking the Political System Theory as the perspective for analysis, and by combining it with the detention cases in the pilot areas, the present study conducts a case analysis and finds that in the joint office of the Commission for Discipline Inspection and the Supervision Committee, there exist such four problems to be solved as how to deal with the relationship between upholding the Party's leadership and ensuring the independent exercise of the supervisory power by the supervisory committee in accordance with the law, how to construct effective mechanism for legal cohesion, how to replace “two rules” with detention, and who to supervise the Inspection Commission. In view of this, there are as follows four effective solution paths to improving further the joint office system of the Discipline Inspection Commission and the Supervision Committee. They are: unifying improving the Party's leadership style with safeguarding the Supervision Committee’s independent exercise of supervision power according to law, optimizing the legal norms and practical measures of “replacing the two rules with detention”, regularizing the leadership system and working mechanism in cohesion with disciplines and laws, and constructing the comprehensive supervisory mechanism for the discipline inspection and supervision organs. |
