美国双重标准的法理解读与启示 |

| 摘 要： 美国法院对法律规范性文件实行宽严不同的审查，并发展出了双重标准理论。但近年来双重标准的内容结构正在转向缓和而具有流动性。双重标准与美国特定的政治经济环境和国际人权问题密切相关。出于人类共同的生活经验和共同的宪法核心价值的原因，美国双重标准理论对我国法规审查标准体系的构建具有启发意义。 |

On American double−standard theory |

| Abstract: The American courts practice different constitutional reviewing examinations, and have developed a dual−standard theory. But the structure of the dual−standard is turning to mobility, therefore the legitimacy of the dual−standard claims a new legal theory. China should use the dual−standard theory for reference to construct its own scrutiny standard because it reflects the common human social life experiences and constitutional principles. We can introduce double−standard by the medium of China’s constitutional norms to practice our own constitutional review. |
