法律与政治的对话：论阿甘本例外状态思想 |

| 摘 要： 阿甘本的例外状态思想不仅推动法学思考自身学科的根本问题，也直面人类行动领域中法律与政治、规范与失范之间的对话，并对主权概念作出了更加有力的反思。此外，就实践而言，当代世界是一个法治与法外治理同时极大化的张力场域，一方面，在“规范性框架中运行”是权力的标准说辞；另一方面，权力的实际运行总是越过规范性边界。对此，只有超越实在法视野，对例外状态进行严肃思考，才能探索构成人类共同生活秩序的整体之“法”。而以阿甘本的例外状态思想观照中国的政治法律实践，也将获益良多。 |

Dialogue between law and politics: On Agamben’s theory of state of exception |

| Abstract: Agmaben’s thought of state of exception does not only propel legal theory to consider its fundamental question, but also faces up to the dialogue between law and politics, norm and anomie in the area of human behavior, and further makes a more powerful introspection into the concept of sovereignty. In addition, from the viewpoint of practice, modern world is an area in which “rule of law” and “rule beyond law” are both powerful. On the one hand, “in the normative framework” are the standard words of power; On the other hand, the operation of power in fact always crosses the normative border. About this, only when we consider the state of exception seriously beyond the view of positive law, can we have an understanding of the “law” of the whole order of human’s common life. Furthermore, it is beneficial for us to think about the political and legal practice of China from the perspective of Agamben’s theory of state of exception. |
