“一带一路”中国企业投资老挝的国民待遇问题 |

| 摘 要： 中国企业投资老挝对于共建“一带一路”具有重要作用。在老挝投资的中国企业正面临着“国民待遇”这一关键问题的挑战。虽然老挝外资法、区域投资协定以及多边条约中有关国民待遇的规定为中国企业提供了法律上的保障，但老挝外资制度、投资争端解决机制以及中老双边投资协定存在诸多问题。老挝应进一步完善投资立法，根据经济发展水平充分给予中国企业“国民待遇”。同时，中国政府和中国企业也应采取必要的应对措施，最大程度地降低投资风险，实现中国与老挝的互利共赢。 |

National treatment in terms of Chinese enterprises investing in Laos in the background of OBOR |

| Abstract: It plays an important role for Chinese enterprises to invest in Laos in building “the Belt and Road.” These Chinese enterprises which invest in Laos are faced with the challenge of “national treatment.” Laos domestic law, regional investment agreements and multilateral treaties in the regulations on national treatment provide guarantee for Chinese enterprises. But, there are many problems in Laos foreign capital system, investment dispute settlement mechanism and bilateral investment treaties between China and Laos. Laos should further improve the investment legislation, and fully give national treatment to Chinese companies according to the level of economic development. At the same time, the Chinese government and Chinese enterprises should also take the necessary measures to minimize the investment risk and realize the mutual benefit and win-win between China and Laos. |
