重要立法事项第三方评估机制研究 |

| 摘 要： 为解决由于部门利益之争而导致的立法久拖不决现象，有必要对重要立法事项引入第三方评估制度。第三方评估的主体应当由具有专业性、中立性、公信力的机构担任，可以建立第三方评估机构信息库。当出现重要立法事项且因部门利益而产生争议时，立法决策机关或争议双方可委托第三方评估机构对之进行评估。第三方评估机构按照一定的评估程序，在与各方协商的基础上作出公正的评估报告。评估报告应转化为立法决策机关的决定，作为立法决策的重要依据。 |

Research on the third party evaluation mechanism of important legislative matters |

| Abstract: In order to solve the serious procrastination in legislation which results from disputes over departmental benefits, it is necessary to introduce the third-party evaluation system in important legislation matters. The third party assessment institutions should be professional, neutral and trustworthy, and the information warehouse of the third party assessment institutions should be established. The legislative decision-making authority or the disputing parties may entrust a third party appraisal institution to evaluate it when the disputes arise in important legislation. According to certain evaluation procedure, the third party appraisal institution may make a fair assessment report based on the basis of consultation with each party. The evaluation report should be transformed into the decision-making of the legislature, which is an important basis for the legislative decision. |
