| 摘 要： 国际科技合作中的知识产权侵权诉讼是一种涉外知识产权侵权诉讼，存在着诉讼主体资格、诉讼管辖权及法律适用等方面的复杂问题。分析和解决这些问题，不仅对国际科技合作具有预警和保护作用，对涉外知识产权侵权诉讼也具有指引功能。 |

On tortuous lawsuit of intellectual property rights in

| Abstract: There exist such complicated problems as qualification of litigation subject, jurisdiction and applicable law in tortuous lawsuit of intellectual property rights in international cooperation of science and technology involving foreign affairs. Analyzing and resolving these problems can not only defend and protect the international cooperation of science and technology, but also direct the tortuous lawsuit of intellectual property rights involving foreign affairs. |
