论人权价值实现的双重意蕴 |

| 摘 要： 在人类生活世界，人权价值是最能体现人的本质的价值尺度。人权价值作为一种正当性价值，是始源性价值、低限价值、构成性价值和多样性价值的统一。在人类发展的历史进程中，理性是把人权价值实现于“人本身”，进而展开人的本质的逻各斯力量。人权价值的理论实现并不当然意味着生活实现。从理论实现到生活实现是人权价值的时代要求。人权价值的双重实现是作为一种过程展开的，是思想手段与生活目的、理论形式与实践内容的双重统一。把握人权价值双重实现的生成路径，要解决思想手段能否为生活目的提供合理性举措，理论形式能否促进实践内容朝着正确方向发展的问题。制度化法治与人情化德治的会通，从理性积累到民主进步的现实需求，从保障公共福利到对弱势群体权益的维护，促进社会经济文化观念等的良性可持续发展，是人权价值双重实现的重要生成路径。 |

On the dual implications of the realization of the value of human rights |

| Abstract: In the world of human life, the value of human rights is the very value dimension of human nature. As a legitimate value, the value of human rights is the unity of start-derived value, low limit value, constituted value and diversity value. In the history of human development, rationality is the logos power that realizes the value of human rights in “the person himself”, and unfolds the essence of the person in the process of realizing the value of human rights. But the theoretical realization of the value of human rights does not mean its life realization. From theoretical realization to life realization lie the era requirements of the value of human rights. To grasp the generation path of the dual realization of the value of human rights, it’s necessary to solve the problem whether the ideological method can provide reasonable measures for the purpose of life and whether the theoretical form can promote the development of the practical content in the right direction. The communication between the institutionalization of the rule of law and the humanization of morality, the real needs from rational accumulation to democratic progress, the protection of public welfare and the interests of vulnerable groups, the sustainable and healthy development of social economy and culture, are the important generation paths to achieve the double realization of the value of human rights. |
