3D打印背景下的专利制度变革研究 |

| 摘 要： 3D打印开放创新是以产品设计图作为核心要素发展起来的，具有创新主体社会化和行为民主化相互促进的特点，并且形成了产品发明成果集成化与权利碎片化的耦合发展。相对于3D打印创新活动的特点，现行专利制度存在专利授权的门槛较高、保护制度过于僵化，以及权利人实施义务缺失等问题。对此，我国应进行专利制度的变革，实现专利授权机制的灵活化，同时强化专利权人获得保护后应承担的义务，并在新的专利法框架下实现利益平衡，以促进3D打印产业的有序发展。 |

On the reform of patent regime in the background of 3D Printing |

| Abstract: Theopen innovation of 3D printing develops on the basis of the product design as a core element, which has the characteristics of mutual promotion between socializing innovation mainbody and democratizing the act, and which has formed the coupling of integration of product innovation and fragmentation of invention rights. Compared with the characteristic of 3D printing innovation activities, the current patent system has such problems as higher threshold of right acquisition, the fossilization of patent protection system, and the lack of implementing duties. Therefore, it is necessary to reform the patent regime, to implement patent authorization mechanism flexibly, to strengthen the duty of patentee for patent protection, and to balance the interest in the new framework so as to promote the orderly development of 3D printing industry. |
