3D数字模型的复制权保护探析 |

| 摘 要： 3D数字模型是3D打印中最为核心的要素，用户主要通过CAD软件设计或3D扫描获得3D数字模型。具有独创性的3D数字模型可以作为美术作品或图形作品受到著作权的保护。对3D数字模型的复制表现为不改变作品载体表现方式的复制和从平面到立体的复制。其中，对构成美术作品的3D数字模型进行打印属于平面到立体的复制，而对构成产品设计图的3D数字模型的打印不构成著作权法意义上的复制。在现行著作权法框架内，建议通过成立著作权集体管理组织、采用著作权技术保护措施和限制私人复制范围等方式对3D数字模型的复制权进行保护。 |

| Abstract: 3D digital model is the core element of 3D printing, and its users obtain a 3D digital model through CAD software designing or 3D scanning. A 3D digital model can be protected by copyright as an art or graphic work if it meets the requirement of originality. Replication of 3D digital model can be manifested in two ways. One is copying the digital file and the other is duplicatinga 3D digital modelfrom two-dimensional to three-dimensional. “Printing” a3D digital model belongs to replicating works of fine art while “printing” a3D digital model of product design cannot be treated as a replication act. In the framework of the current copyright law, we can protect the reproduction right of 3D digital model by establishing copyright collective management organization, taking the copyright technology protection measures and limiting the scope of private copying. |
