农村土地承包经营权信托受托人适格研究 |

| 摘 要： 信托分为商事信托与民事信托，在商事信托中还有金融信托，法律对金融商事信托的受托人有着严格的资格要求。在农村土地承包经营权信托中，受托人也存在资格性要求。因受托人在信托中处于核心地位，其适格受托人是农村土地承包经营权信托研究的关键，也是农村土地承包经营权信托流转制度构建的重要组成部分。基于《信托法》和《农村土地承包经营法》的要求，可从民事信托和商事信托等两个方面界定适格受托人，应澄清只有信托公司才有资格担任农村土地承包经营权信托受托人的认识误区。 |

| Abstract: Trust is divided into commercial trust and civil trust. Financial trust is part of commercial trust, which has strict eligibility requirements to the trustee by law. These requirements also apply to rural land contract and management right trust. Since the trustee is thekey part of trust, it also plays an important role in rural land contract and management right trust. Based on the requirements of the “Trust Law” and the “Rural Land Contract Law,” trustee eligibility can be defined in both commercial trust and civil trust. It also needs to be stated that only trust companies are qualified to clarify all those misunderstandings for trustees in rural land contract and management right trust. |
