公益告发制度研究 |

| 摘 要： 为了防止组织违法行为损害社会公共利益，不少国家都对公益告发进行立法，以鼓励组织“内部人”将组织违法信息向可以对此采取行动的个人或机构进行披露。公益告发制度可以较好地解决组织与社会之间的利益冲突问题，在组织行为监控、职场伦理变革、增进政治民主及促进公共法律的执行等方面都有着重要的价值。公益告发有内部告发、外部告发及告发人诉讼三种渠道。公益告发制度有三个重要的组成部分：告发人激励制度、告发人约束制度及告发人保护制度。 |

On whistle-blowing legislation |

| Abstract: To prevent an organizations from taking illegal actions to harm the social public welfare, many countries have whistle-blowing legislation to encourage the “insider” of the organization to disclose illegal information of the organization to those individuals or organizations which can take action on these issues.Whistle-blowing policy can solve the conflict between the organization and the society, and has an important value in supervising organizational behavior, reforming workplace ethics, promoting political democracy and implementing public law. There are three channels for public-interest whistle-blowing: internal whistle-blowing,external whistle-blowing and whistleblower litigation. And public-interest whistle-blowing legislation consists of three important components: whistleblower incentive system, whistleblower constraint system and whistleblower protection system. |
