从文本到实践:论教育平等权的宪法保障及其路径选择

摘  要: 我国“八二”宪法虽然明确规定了公民的受教育权利,但是教育平等权却是间接得来的。教育平等权的内涵虽在学界未达成共识,但应蕴含两类平等性原则:形式及实质之平等原则。我国宪法文本对教育平等之规定经历了从“入宪”到“删除”,随后从“再次入宪”到“强调权利属性的教育平等”之发展历程。实践中,更是因为教育平等权之法律文本缺位,使得公民应当平等享有的宪法基本权利受到本质的侵害。在思考教育资源公平配置且效益最大化的同时,提出教育平等权之宪法确认、教育平等权之宪法救济及其技术路径。

From text to practice: the protection of equal rights of education constitution and its path choice

Abstract: In 1982, the Constitutional text defined the citizen education rights clearly, but education equality was indirect. The connotation of education equality should contain two principles though there is no agreement: form and virtual principle of equality. Education equality in constitutional text changed from “writing into the constitution” to “deleting”, and from “again writing into the constitution” to “emphasizing education equality”. In practice, the absence of the legal text makes the equal right of the citizens violated. We should think about the education resources and fair allocation of the maximum profits. At the same time, we should put forward constitutional confirmation, constitutional relief, and take technological path of the education equality.
