农村土地退出路径研究 |

| 摘 要： 现行土地制度导致农村土地资源的低效率，工业化城镇化快速发展背景下的农村土地功能变化，现行农村土地征用制度对农民利益造成的侵害，是本文探索对农村土地退出路径研究的立足点。影响农民退出承包地的关键是对农民的土地承包经营权的补偿方式和补偿标准能否让农民满意。从土地承包经营权方面，应就农民退地的货币化补偿和经营性补偿进行设计考量，通过土地金融创新形成有效、持续和稳定的农地收益；从宅基地使用权方面，应就货币补偿、住房置换、购房补助进行设计考量，并对退地农民在就业、教育、住房和社会保障方面作出可持续发展保障安排。 |

Research on quitting path of rural land |

| Abstract: Existing land system leads to low efficiency of rural land resources, affecting the functions of rural land changes under the background of the rapid development of industrialization and urbanization. The current rural land requisition system causes the infringement of the interests of farmers, which is the foothold the paper explores the quitting path of rural land. The key of influencing farmers’ quitting contract land is whether farmers are satisfied with compensation mode and compensation standard for their land contract operation rights. According to aspect of land contract operation rights, it should consider monetary compensation and operation compensation for farmers due to the fact that their lands are quitted, with financial innovation policy to form an effective, continuous and stable farm land income. In view of homestead right of use, it should take monetary indemnity, housing replacement and housing subsidies into account. Moreover, from ways of employment, education, housing and social security, indemnificatory arrangements to farmers who give up their lands should be rationally made. |
