马克思对“统一的法律”概念的因革及当代价值 |

| 摘 要： “统一的法律”是蕴含在《共产党宣言》中的一个很重要的法律命题。马克思从探究社会分层、劳动异化之扬弃和倡导平民文化实践哲学的具体的语境中将“统一的法律”作为批评的靶子，从批判中超越与创新“统一的法律”，建立形式和内容一致的、自由联合的、为大多数人谋利益的新的社会和政治统一体。马克思这一法律思想对指导我们正确理解不同层面主体对构建“统一的法律”的责任；立足现实建立符合广大人民利益的“法律统一体”；加强法治文化建设，丰富法律统一体内涵，实现在普遍人权充分发展的基础上保障个人人权的有效发展具有重要的意义。 |

Connotation and contemporary values of Karl Marx’s unification of law |

| Abstract: The uniform of law has been a very important law topic contained in Manifesto of the Communist Party. From the specific context of the research of social stratification, the sublation of alienation of labor and advocating the civilian culture practical philosophy, Karl Marx took the “uniform law” as the target of criticism, and he surmounted and innovated the “uniform law” from the criticism, then established the new social and political unity which is coincident with the form and content, and the interests of the most people. This legal thought of Karl Marx has important significance for guiding us to correctly understand the responsibility for the different levels of the subject to construct the “uniform law”, based on the reality to establish “legal entity” of the interests of the people, to strengthen the construction of legal culture, rich the connotation of legal entity so as to realize the effective development of safeguarding individual human rights on the basis of the full development of universal human rights. |
