企业家及其企业的刑事风险与防控 |

| 摘 要： 企业家及其企业的刑事风险是指企业家及其企业的未来因可能发生的刑事犯罪或卷入刑事诉讼而遭受的失败或负面影响，可分为因刑事犯罪引发的风险、因刑事诉讼引发的风险或未然刑事风险、已然刑事风险等各种类型。企业家自身的素养、企业内部的管理和外部的法治环境、外部的关系协调等是形成这种风险的内外因素。企业家及其企业对未然的刑事风险应未雨绸缪，积极防范和化解；对已然的刑事风险应沉着理性，依法予以应对，将损失控制在最小的范围之内。 |

Criminal risk and precaution of entrepreneur and its enterprise |

| Abstract: The criminal risk of entrepreneur and its enterprise is the loss or negative influence caused by the criminal offence possibly occurred or the involvement in a criminal proceeding. The risk can be variably classified, including the criminal offence-caused risk and the criminal proceeding-caused risk, or the inevitable criminal risk and the probable criminal risk, etc. The entrepreneur's own accomplishment, the internal management of enterprises and the external legal environment, and the ability to coordinate external relations, together constitute the internal and external factors causing the risks. Facing the probable criminal risk, the entrepreneur and its enterprise should take preventive measures to actively dissolve the situation, and legally cope with the inevitable criminal risk to control the losses to the minimum degree calmly and rationally. |
