海峡两岸文化产业对接合作中的法律问题及其完善 |

| 摘 要： 海峡两岸文化产业对接合作是新时期两岸经贸互动交流的重要议题，其会涉及到诸多法律调整问题。目前涉及两岸文化产业对接合作的法律规则体系不够完善，且在实务层面未能执行到位。为此，首先应当从著作权法、税法、文化产业法等几个关键领域改良完善两岸文化产业对接合作的法律体系，其次从培植法治意识、健全企业法务组织机构及执行机制、夯实法律人才资源支持基础等方面，确保与两岸文化产业对接合作相关的法律规则执行到位，最终达致海峡两岸文化产业对接合作沿着法治化路径推进之目标。 |

| Abstract: Cross-straits culture industry conjunction and cooperation is an important subject in the new stage’s cross-straits economy and trade communication, which will involve lots of legal regulation problems. The present legal rule system concerning cross-straits culture industry conjunction and cooperation emerges lots of inadequates, which can’t be implemented fully in further practice. So, we should firstly revise and perfect law system concerning of cross-straits culture industry conjunction and cooperation in those desicive fields such as copyright law, tax law, culture industry law; Secondly, we should foster legal awareness, improve law affairs organizational structure and implement mechanism, and sketch the sustainable base of law experts; Finally, we should realize the goal of guaranteeing cross-straits culture industry conjunction and cooperation in a legal way. |
