论我国区域立法委托起草机制 |

| 摘 要： 起草方式的选择直接关系到区域立法文本的质量高低。区域立法可采取一种特殊的委托起草方式，即由各区域立法职权主体共同委托区域立法起草委员会负责起草工作。该委员会由三类成员组成：地方权力机关的代表、地方政府法制机构工作人员和通过公开招标等方式选择的科研组织。委托起草作为一项协调机制，对于区域立法文本内容有着重要的协调意义。区域立法委托起草的实施主要包括作出起草决策、成立区域立法起草委员会，以及搜集与整理相关立法信息、拟订起草方案等步骤。 |

On the Delegated Drafting Mechanism of
Regional Legislation of Our Country |

| Abstract: The choice of drafting ways concerns the text quality of regional legislation directly. Regional legislation can adopt a special delegated drafting way that the drafting work is charged by regional legislation drafting council delegated by all the regional legislation authorities. The council is composed of three members which are the representatives coming from local power organs, the staff coming from the legal department of local governments, and the study organization determined by the way of open tendering. As a coordination mechanism, delegated drafting has important coordination significance to regional legislation text. The operation of delegated drafting of regional legislation contains six steps: to make the drafting decision, to set up the regional legislation drafting council, to collect and settle the relevant legislative information and to draw up the drafting program, etc. |
