村民自治中村民罢免权实现的困境及其制度完善
--兼评《村民委员会组织法》第十六条村民罢免之规定 |

| 摘 要： 罢免权是选举权的延伸，是选举权实现的重要保障，是村民民主监督权的重要内容。尽管现行《中华人民共和国村民委员会组织法》扩大了提出罢免主体的范围、取消了村民委员会召集和主持罢免程序的规定、放宽了通过罢免的法定条件，但是却未规定罢免组织机构，未规定罢免时效，未完善罢免程序，因此很难从根本上消除农民“难罢免”“乱罢免”的现象。建立以村民监督机构、乡镇政府和村民自身的三级罢免启动为路径、以司法监督为保障的罢免机制，是村民自治中村民罢免权实现的重要法律保障。 |

The dilemma and improvement on the realization of the Right of recall in the villager autonomy |

| Abstract: As the extension of the right to vote, the right of recall is not only the important guarantee of realizing the right to vote, but also the important body of the villager democratic supervision. Though the Organic Law of the Villagers Committees of the People’s Republic of China extends to the subject who could put forward recalls corpus, cancels the stipulation that the villagers committees preside over the process of recall, and loosens to pass the legal condition for recall, but it doesn’t stipulate who and when to organize the recall process. Apparently it is very difficult to realize the right of recall as before. Now it is very important to construct the triple system to organize the recall process and the judicial supervision system to guarantee the villagers’ right of recall so as to carry out in the villager autonomy. |
