法家变法与大一统帝制形成的理论逻辑

摘  要: 法家兴起于传统礼制秩序的衰落,以“世异事异”的历史变迁论为变法改制的正当性进行学理论证。总的来看,法家思想的最大特点在于最大限度地进行社会军事动员,其政策以战争为导向,改变了传统的战争人力资源结构,增强了国家财政汲取能力,并把由军事纪律衍生出来的法律规定转变成组织管理手段。法家变法以集权动员的高能效,创造出了中央集权的皇权大一统结构,而法家的变法措施既依赖同时又巩固这种权力结构,最终为中央集权的皇权大一统专制铺平了道路。

Thoughts on political reform of Legalist school and formation of the Great Unity Emperialism

Abstract: Legalist school rises from the fall of traditional ritual order and argues that political reform is legitimate in theory on the base of historical change. In general, the major character of Legalist school is to conduct social military mobilization in maximum. Legalist school’s policy proposed Military merit awards and changed the traditional structure of human resources in war, and developed agriculture and reinforced state’s capacity for gaining money from society, and changed the law which derived from military discipline into the major organized method. Legalist school created the structure of the unification of imperial power which centralized in the Central Authorities from the high efficiency of centralized mobilization. The reform policy of Legalist school is both dependent on and to strengthen the structure above. There is a mutual promotion between them, which can prepare the way for the tyranny of the unification of imperial power.
