医疗服务市场失范的经济法规制 |

| 摘 要： 医疗市场化改革以来，政府过度注重经济增长速度，忽视了公民健康权，没有有效保障基本医疗公共服务。医疗服务市场出现的失灵应当通过经济法加以规制，以实现医疗公平性和普遍均等化。当前，医疗服务的市场调节失灵包括信息不对称、不正当竞争和医疗商业贿赂。政府并没有履行好国家调节职能，降低了医疗可及度，出现了公立医院垄断、医疗公共服务缺位的双失灵。通过经济法规制医疗市场，应当完善医疗信息公开制度，细化反垄断法执法标准，彻底实现管办分离，保障基本医疗公共服务的供给。 |

Regulation on the anomie of medical service market by Economic law |

| Abstract: Since the health care market reforms, our government has placed over-emphasis on economic growth and ignored the citizens’ health right, while failed to provide basic medicalcare services. In order to achieve equity and universal equalization, the failure of medical market should be regulated by economic law. Currently, market failure of medical services include asymmetric information, unfair competition and commercial bribery. The government didn’t perform the functions of economic regulation, while increasing market imperfections, which leads monopoly of public hospitals and absence of medical public service. When government regulates the health care market, it should consummate medical information disclosure system, detail anti-monopoly law standards, realize the separation of holding and managing hospitals, and protect the supply of basic medical public service. |
