自然法的堕落
──德意志第三帝国法律思想探秘 |

| 摘 要： 德意志第三帝国时期法律思想表面上呈现出十分强烈的反自然法特征，但就其实质而言，它的一系列法律制度又不可避免地利用并发挥了自然法的一些特性，对此可称之为“自然法的堕落”。自然法的堕落有其复杂的深层次的原因，这当然也与第三帝国法律思想渊源有关，尤其是自然法的某些本质特征与第三帝国时期的主要社会意识形态的交替作用，最终导致了自然法在德国世俗社会的堕落，其表现形式是多方面的。这一时期德国立法指导思想及其法律思想的核心内容乃是十分激进与变态的，它值得我们深刻反省。 |

| Abstract: The German legal thought during the Third Reich shows strong characteristics of anti-natural law, but in its essence, a series of legal system unavoidably used and showed a number of characteristics of natural law, which we call “The Fall of Natural Law.” Degradation of natural law has its own complicated causes, this is of course connected with the legal thought of the Third Reich (that is, thought of natural law), in particular, the essential feature of natural law and the Third Reich during the turn of the main social role of ideology, which eventually led to the fall of the natural law, and its manifestations are manifold. In short, in this period the guiding ideology of the German legislation and the core of legal thinking are very radical and metamorphosis, which deserves our deep remorse. |
