| 摘 要： 法律不完备为社会资本对行政裁量的侵袭预留了空间，而裁量主体在行为过程中的“经济人”取向则是裁量正义难以实现的直接原因。必须利用裁量基准等制度进一步完善行政裁量规则，完善行政机关内部分权以强化对行政裁量的制约，压缩行政裁量的空间，为公务员抵抗社会资本的干扰提供挡箭牌。同时，强化责任追究机制和行政伦理建设，降低裁量滥用的激励。 |

| Abstract: Because of incompleteness of law reserves space for social capital invasion, “economic person” orientation of discretionary subject causes difficult to achieve discretionary justice directly. We should use discretion standard system to further improve the administrative discretion rule, perfect administrative decentralization in order to strengthen the restriction mechanism of administrative discretion and compress the discretionary space, so as to provide shield for civil servant used to resist social relations interference. At the same time, we should strengthen the accountability mechanism and the construction of administrative ethics, while reducing motivation of discretion abuse. |
