宪法权利诉求的经济学逻辑 |

| 摘 要： 关于宪法权利的诉求更多表现为权利的呼喊,或者以攀比的心理运用复杂理论进行中西的比较，增加思维成本的同时却未带来明显的收益。事实上，宪法权利的背后隐藏着经济学的逻辑，其影响着宪法权利的现实脉象。基于各种原因，经济学的理路没有作为“拿到桌面上”的理由加以论证。宪法权利作为政府向社会投资的公共物品，必将受到政府财政预算和支付能力的约束。政府的社会控制水平、潜在宪法权利享有者的诉求、法律适用部门的制度转换能力以及政府的利益协调机制，都将产生巨大的交易费用。为了降低风险，政府会将投资分布在各种权利之上，同时要考虑各个权利的实施成本，任何政府都不可能为了个别权利而不惜任何代价。因此，对于权利话语的呼喊者而言，如果追求真理需要付出过高的成本，那么降低真理的标准就是明智的选择。 |

Narrative in ecnomics of constitutional rights |

| Abstract: Discourses on the constitutional rights are cries of rights, or using complexity theories to make a comparison between Chinese and Western. It increases thinking costs, but fails to bring significant benefits. In fact, behind the constitutional rights there is hidden logic of economics. It impacts on the reality of the constitutional rights. Constitutional rights are seen as the government investment public goods to society, which is restricted by the government budget and the ability to pay. The government's level of social control, potential people of constitutional rights enjoyed, conversion capability of the department's system, and the government’s interests coordination mechanism will generate huge transaction costs. In order to reduce the risk of investment in government, it will distribute a variety of rights, and take into account the cost of the implementation of the various rights. Any government is impossible to endow individual rights at any cost. Therefore, if the pursuit of truth needs to pay a high cost, then reducing the standard of truth is a wise choice. |
