| 摘 要： 随着工业化和经济全球化的发展，陆地资源短缺的矛盾越来越突出，海洋利益成了一国利益的重要方面。海洋利益是人们围绕或通过海洋而结成的经济关系。海洋利益包括海洋产权的界定、使用、收益、保护等方面。海洋利益具有超国家性、外部性、产权残缺等特点。从海洋利益产权的特殊性出发，通过合理界定各国权益边界、特许经营权拍卖、加强海权建设等方式，能有效地维护中国海洋权益，促进海洋资源的可持续开发利用，促进中国经济的可持续发展。 |

Property rights and the theory of interests of sea |

| Abstract: Along with the development of the industrialization and the economic globalization, the contradiction of short of land resource is becoming more and more outstanding. The interest of sea becomes an important aspect of state interests. The sea interest is the interest relations that has been coming into being because of the sea. The sea interest includes the definition, utilization, the profit and the protecting of sea interest. The features of sea interest include the super-nation, externalities, truncation of property rights etc. According to those characteristics, we should pay attention to the problem of Maritime Boundary through the method of auction of property rights, strength the building of sea power, etc, so as to promote the sustainable using of sea resource, thus promoting the sustainable of China’s economiy. |
