律典对传统统治正当性的依附与证成
--以《大清律例》为中心的分析 |

| 摘 要： 清律律文承载着法传统中的核心价值和理念。与例文因时制宜地适应司法实践不同，解决司法问题不是律文的唯一价值，在一定程度上，律文还具有某种符号意义。《大清律例》采取的律例合编体例，较好地兼顾了传统政治理想与社会现实之间的冲突与统一。律文从律典传统中承继了圣人治理哲学，道德化的天命来源和弼成教化的立法目的是这种圣人治理哲学在立法领域的表现，清律所包含的大量具文所具有的宣示“秩序的理想”意义进一步表明了圣人治理的立场。从而，依附于政治的律文为政治哲学所指导并从统治权威中获得正当性的同时，又反过来，通过标示社会传统和秩序理想，进一步地宣示了统治权威的正当性。 |

On the symbolic meaning of Qing Code for the rule of legitimacy |

| Abstract: Qing’s statute inherited the core value and philosophy of law tradition, and paid attention to traditional political ideal and social reality between conflict and coordination. Unlike the Case is concerned in adapt to judicial practice, the Statute has more important tasks not only in solving the problem of justice statutes but also in making a symbolic meaning, in some way. And the philosophy of rule by Sages, the destiny source with morality, as well as the mission of rule by humanize, which all make the construction of the declaration of “ideal order” turn into law. Moreover, the Statute which depends on the politics, guided by the political philosophy and obtains legitimacy from the authority goes further to announce its legitimacy through indicating the social tradition and the ideal of rule. |
